MERIDIAN
END USER LICENSE AGREEMENT

This End User License Agreement ("Agreement") is a legal agreement between
you and Meridian Simulation Operations, LLC, an Oklahoma limited liability
company ("Meridian"). It covers the Meridian software, including the desktop
application and the services at meridiansimops.com (the "Software").

The Software is licensed, not sold. Installing or using it does not transfer
ownership. All title and copyright in the Software remain with Meridian.
All rights not expressly granted are reserved. The Software is not open
source, and it is not in the public domain.

By installing or using the Software, you agree to this Agreement. If you do
not agree, do not install or use it.


1. LICENSE

Meridian grants you a personal, non-exclusive, non-transferable, revocable,
limited license to install and use the Software on computers you own or
control, for flight simulation. The license covers a free testing copy and
a copy you have paid for. Payment does not make you the owner of the
Software.


2. RESTRICTIONS

You may not redistribute, publish, mirror, sell, rent, lease, sublicense,
or repackage the Software, including by way of an upload site, a torrent,
Discord, or a forum. You may keep one private backup.

You may not remove copyright notices, present the Software as your own
work, or make the Software available as a service to other people.


3. THIRD-PARTY DATA AND MARKS

Meridian is an independent product. It is not affiliated with, endorsed by,
or sponsored by Microsoft, Xbox, Asobo, Microsoft Flight Simulator, VATSIM,
IVAO, the Federal Aviation Administration, NAV CANADA, NATS, MapTiler,
OpenStreetMap, adsb.lol, Planespotters.net, Navigraph, Jeppesen, ChartFox,
or SimBrief. Their names and marks remain their property. Where their data
appears in the Software, it is used under their own terms.

The following data are supplied by third parties. Credit is given as
required by those providers.

  United States radar, current: NOAA, Multi-Radar Multi-Sensor (MRMS).
  United States radar, forecast: NOAA, High-Resolution Rapid Refresh (HRRR).
  Temperature, pressure, precipitation, cloud cover, and wind: NOAA, Global
  Forecast System (GFS).
  Satellite imagery, and lightning over the Americas: NOAA, GOES.
  Convective outlooks: NOAA, Storm Prediction Center.
  United States instrument procedures, where shown: Federal Aviation
  Administration.
  Temporary flight restrictions: Federal Aviation Administration.

Works of the United States Government are in the public domain. All other
third-party data remain subject to the provider's license.


4. SIMULATION ONLY

Tracks, weather, traffic, charts, and procedures in the Software are for
flight simulation only. They are not for real-world navigation, flight, or
dispatch.


5. DISCLAIMER OF WARRANTY

THE SOFTWARE IS PROVIDED "AS IS" AND WITH ALL FAULTS. TO THE MAXIMUM EXTENT
PERMITTED BY LAW, MERIDIAN DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED,
INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND
NON-INFRINGEMENT. YOU USE THE SOFTWARE AT YOUR OWN RISK. THE SOFTWARE MAY
BE INCOMPLETE, INACCURATE, OR UNAVAILABLE, AND IT MAY NOT MATCH YOUR
SIMULATOR OR COMPUTER.


6. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MERIDIAN SIMULATION OPERATIONS, LLC
IS NOT LIABLE FOR ANY LOSS ARISING OUT OF THE SOFTWARE, INCLUDING LOSS OF
DATA, SIMULATOR TIME, HARDWARE, OR NETWORK ACCESS.

IF LIABILITY CANNOT BE EXCLUDED, IT IS LIMITED TO THE AMOUNT YOU PAID
MERIDIAN SIMULATION OPERATIONS, LLC FOR THE SOFTWARE IN THE TWELVE MONTHS
BEFORE THE CLAIM. IF YOU PAID NOTHING, THE LIMIT IS ZERO.

SOME PLACES DO NOT ALLOW THESE EXCLUSIONS OR LIMITS. IN THOSE PLACES, THEY
APPLY ONLY TO THE EXTENT THE LAW ALLOWS.


7. TERMINATION

If you do not comply with this Agreement, the license ends. You must then
delete the Software.


8. GOVERNING LAW

This Agreement is governed by the laws of the State of Oklahoma, without
regard to conflict-of-law rules. The state and federal courts located in
Oklahoma County, Oklahoma have jurisdiction. Meridian may seek an injunction
in any court of competent jurisdiction to protect the Software.
